What actually happens when you file bankruptcy, step by stepA consumer bankruptcy is mostly paperwork, one short meeting, and waiting. The real work happens before filing: gathering documents and preparing accurate schedules. After filing, the automatic stay protects you immediately, the 341 meeting comes about a month in and lasts minutes, and in a Chapter 7 the discharge typically arrives about two months after that, roughly four months start to finish. Chapter 13 follows the same opening, then runs its three-to-five-year plan.
The two required courses: credit counseling and debtor educationEvery filer takes two short courses from approved providers: a credit counseling briefing before filing (your certificate must be no older than 180 days on filing day) and a debtor education course after filing, required before the discharge issues. Both are about an hour, online or by phone, cost roughly $10 to $50 each with fee waivers available, and neither is a test you can fail. The only way they hurt you is by being forgotten.
Who is the trustee, and what do they actually do?The trustee is a private professional, usually a lawyer or accountant, appointed to administer your case: verify your paperwork, run the 341 meeting, and, in Chapter 7, look for non-exempt assets to distribute to creditors (in most cases there are none). In Chapter 13, the trustee collects your plan payments and pays creditors. The trustee is not your lawyer and not your enemy; they're the system's auditor, and honest paperwork is the entire relationship.
